HEARINGS EXAMINER

The City of Tumwater had created the position of Hearings Examiner pursuant to state law. The hearings examiner shall interpret, review and implement land use regulations as provided in the Tumwater Municipal Code or as provided by any other ordinances of the city.

The powers of the hearings examiner shall be to conduct open record predecision hearings and open record appeal hearings and render decision on such matters as are within the examiner's jurisdictional authority. The examiner shall receive and examine all available information, conduct public hearings and prepare a record thereof and enter decisions as provided for herein for the following matters: Variances; Conditional use permits; Preliminary plats; Administrative land use appeals; Shoreline permits; SEPA appeals; Site-specific rezone not requiring a Comprehensive Plan amendment; Planned unit development; Impact fee determinations; Concurrency determinations; to name a few.

The decision of the hearing examiner shall be final unless such decision is appealed to the city council. The full text of the duties and responsibilities may be found in the Tumwater Municipal Code 2.58.
