VARIANCES
 
"Variances" are modifications of zoning regulations applicable to a specific piece of property that may be granted by the Tumwater Hearing Examiner in cases where the unusual nature, shape, exceptional topographic conditions, or extraordinary situation or conditions connected with the property create circumstances where literal enforcement of zoning regulations would pose undue hardship on an applicant (TMC 18.04.640).  Information on the variance process is found in TMC Chapter 18.58. 

Applications for variances are administered by the Planning and Zoning Services Division of Development Services.

CONDITIONAL USES
 
"Conditional uses" are uses of property allowed for individual locations in a zoning district (with specific development conditions) upon approval by the Tumwater Hearing Examiner (see TMC 18.04.135). Conditional uses that may be considered by the Hearing Examiner are listed in the conditional use section of each zoning district chapter of TMC Title 18. 

Applications for conditional uses are administered by the Planning and Zoning Services Division of Development Services.

18.04.135 Conditional uses.
"Conditional uses" means certain uses which because of special requirements or unusual characteristics related to the subject property, or because of possible detrimental effects on surrounding properties, may be permitted in use districts if found under the conditional use section, and after the granting of a conditional use permit by the hearings examiner. Conditional uses require a special degree of control to make such uses consistent with and compatible to other existing or permissible uses in the same zone or zones.
